The term "Polyvagal Acupuncture" is the exclusive and proprietary brand mark of Polyvagal Acupuncture Inc. and our Blog "Down the Polyvagal Rabbit Hole" since 2024. This mark functions as our Service Mark (SM), used exclusively to identify and distinguish two distinct offerings: 1) The professional therapeutic services provided under this system, and 2) The associated postgraduate curriculum, training, and unique, protected techniques taught therein.
A federal application for registration of this mark is active, and currently pending, establishing our earliest priority rights and providing constructive notice under the law.
2. Explicit Warning of False Representation and Consumer Fraud
As of 2024, the comprehensive post-graduate CEU curriculum for the Polyvagal Acupuncture methodology is proprietary and in ongoing development. While foundational educational content and instructional concepts have been offered since 2024, the formalized certification program leading to authorization is still under development. Therefore, no individual or entity has been granted authorization, license, or the right to represent themselves as a certified practitioner or instructor of "Polyvagal Acupuncture."
Any public representation of authorization, affiliation, or use of this Service Mark by a third party is a direct, false representation of a material fact made to the consuming public, constituting an act of both intentional Trademark Infringement and state-level Consumer Fraud.
